The Property (Digital Assets) Act, which received Royal Assent from King Charles last week, provides the legal certainty that digital assets, including cryptocurrencies and non-fungible tokens, are now officially recognized under UK law. Beyond clarifying ownership rights, this development has significant implications for the country’s rapidly evolving crypto gambling and iGaming sectors.

For context, until now, property law in the United Kingdom recognized only things in possession, such as physical objects, and things in action, such as debts. Cryptocurrency had previously been treated as property on a case-by-case basis in courts, leaving investors, operators, and users in legal uncertainty.

The new legislation introduces a third category specifically for digital assets, establishing clear ownership, transferability, and recovery rights in cases of theft or fraud. Importantly, it also ensures that digital assets are included within insolvency and estate processes, protecting holders in complex financial situations.

Gurinder Singh Josan, co-chair of the Crypto and Digital Assets All Party Parliamentary Group, further highlighted that this move gives consumers stronger protections and clear ownership rights. That being said, more related developments are expected.
